By selecting “I Agree”, creating an account, or using the Platform, you agree to these Beta Participation Terms (“Terms”) with AskMyu, LLC (“Company,” “we,” “us”). If you do not agree, you will not be permitted access to the Platform.
1. Beta Program Status. The Platform is an beta-stage product that has progressed beyond early-stage alpha testing but remains under active development. Features may change, be unavailable, or contain errors. The Platform is provided for testing, evaluation, and feedback purposes and may be modified, suspended, or discontinued at any time. Your participation is voluntary. AskMyu anticipates that the beta period will begin on or about September 1, 2026 and will continue until AskMyu determines that the Platform is ready for general commercial availability. The duration of the beta period is not fixed and is subject to change in AskMyu’s discretion.
2. Permitted Use. Access to the Platform is granted for the purpose of evaluating the Platform, providing feedback to AskMyu, and any authorized pilot deployment expressly approved by AskMyu in writing. You agree that you will use the Platform only for lawful purposes, will not attempt to gain unauthorized access to any portion of the Platform or related systems, will not reverse engineer or attempt to copy the Platform or its underlying technology, and will not use the Platform for any commercial purpose without AskMyu’s prior written consent. AskMyu reserves the right to monitor use of the Platform to ensure compliance with these Terms.
3. Use at Your Own Risk. You understand that the Platform may not function as expected, information may be incomplete or inaccurate, and reliance on the Platform is at your own risk. The Platform is provided “AS IS” and “AS AVAILABLE.” AskMyu makes no warranties of any kind, whether express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or accuracy. Notwithstanding the foregoing, AskMyu will use commercially reasonable efforts to provide advance notice of planned outages or material service interruptions during the beta period.
4. Feedback Ownership. If you provide suggestions, ideas, comments, workflow insights, or other feedback about the Platform (“Feedback”), you agree that AskMyu owns all Feedback, you assign all rights in Feedback to AskMyu, and AskMyu may use Feedback for any purpose including product development and commercialization. You will not receive compensation for Feedback. You represent that any Feedback is your original work and does not infringe the rights of any third party.
5. Confidentiality. Because this is a beta program, the Platform, its features, functionality, performance, and all related non-public information are confidential and proprietary to AskMyu. You agree not to share screenshots, recordings, or product details publicly, not to discuss non-public features, performance, or roadmap information with any third party, and not to reverse engineer or attempt to copy the Platform. You further agree not to input any personally identifiable information, financial data, or sensitive personal data into the Platform during the beta period. Your confidentiality obligations survive termination of your participation for a period of two (2) years. Notwithstanding the foregoing, AskMyu may, with your prior written consent, identify you as a beta participant in customer references, case studies, or marketing materials.
6. Data and Privacy. By using the Platform, you acknowledge that AskMyu may collect and process data you input into or generate through the Platform, as well as usage data and analytics. AskMyu may use data collected through the beta program to improve, develop, and commercialize the Platform. AskMyu’s collection and use of personal information is governed by its Privacy Policy, which is incorporated into these Terms by reference.
7. Intellectual Property. The Platform, including all software, content, design, trademarks, and underlying technology, is the exclusive property of AskMyu and its licensors. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for beta evaluation and any AskMyu-authorized pilot use purposes. Nothing in these Terms grants you any ownership interest in the Platform or the right to use AskMyu’s name, logo, or trademarks without prior written consent.
8. Limitation of Liability. To the maximum extent permitted by law, AskMyu will not be liable for data inaccuracies, service interruptions, loss of data, business interruption, or indirect or consequential damages. AskMyu’s total liability will not exceed the total amounts actually paid by you to AskMyu under these Terms, which in a free beta program is zero. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so the above limitations may not apply to you in full.
9. Termination. AskMyu may suspend or terminate access at any time, with or without cause or notice. You may discontinue participation at any time by notifying AskMyu. Upon termination, your license to use the Platform immediately ceases, and you must destroy any confidential information in your possession. Sections 4, 5, 6, 7, 8, and 10 survive termination. AskMyu will provide reasonable assistance to allow you to export your data for a period of thirty (30) days following termination, subject to applicable law.
10. Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Boston, Massachusetts. You and AskMyu agree that each may bring claims only in an individual capacity and not as part of any class or representative action.
11. General. These Terms constitute the entire agreement between you and AskMyu with respect to the beta program. AskMyu may update these Terms at any time; continued use after notice of updated Terms constitutes acceptance. If any provision is held invalid, the remaining provisions continue in full force. 12. Acceptance. By selecting “I Agree”, you confirm that you have read and understood these Terms, that the Platform is an beta product provided AS IS, that you agree to feedback ownership and confidentiality obligations, and that you accept the risks of participation.
13. Release; Indemnification; Assumption of Liability. Various federal and state privacy laws may apply to your use of the Platform. You are choosing to participate in a free beta program. You know the Platform uses AI to process the inputs you submit. You have read these Terms. You are making an informed, voluntary decision. In that context, by participating you are confirming that your consent is knowing and voluntary, and that you are not relying on these Terms to create a private right of action against AskMyu arising from your voluntary beta participation. The disclosures below and in Appendix A explain what the relevant laws provide and how they apply to you.
(a) Consent to Data Processing; Waiver of Wiretap Claims. You expressly and affirmatively consent to AskMyu and its authorized third-party service providers processing, transmitting, receiving, and analyzing any and all communications, data inputs, and interactions you submit through the Platform. You acknowledge this consent is given voluntarily as a condition of accessing the beta. To the maximum extent permitted by applicable law, you hereby release, waive, and forever discharge AskMyu from any and all claims arising under any applicable federal or state wiretapping, interception, eavesdropping, or communications privacy statute in connection with your use of the Platform. Applicable state-specific disclosures are set forth in Appendix A.
(b) Biometric Data Release. The current beta Platform does not collect biometric identifiers. To the extent any future feature of the Platform involves biometric data collection, you agree to provide the consents required under applicable biometric privacy laws prior to such use, and to release AskMyu from claims arising from such collection in connection with your participation. Applicable state-specific requirements are set forth in Appendix A.
(c) Consumer Health Data Release. To the extent your use of the Platform involves the collection or processing of consumer health data as defined under applicable state law, you hereby: (i) provide your express consent to AskMyu’s collection and processing of such data as necessary to provide the Platform; and (ii) to the maximum extent permitted by applicable law, release AskMyu from all claims arising from such collection or processing in connection with your beta participation. State-specific disclosures and definitions are set forth in Appendix A.
(d) General Privacy and Data Claims Release. To the maximum extent permitted by applicable law, you hereby release, waive, and forever discharge AskMyu and its officers, directors, employees, agents, successors, and assigns from any and all claims, demands, causes of action, losses, liabilities, damages, costs, and expenses (including attorneys’ fees) of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, arising out of or relating to (i) the collection, processing, storage, sharing, or use of your personal data, personal information, sensitive personal information, or consumer health data in connection with your beta participation; (ii) any alleged violation of any federal or state privacy, data protection, or consumer protection statute, regulation, or common law duty, including without limitation all applicable federal and state privacy, data protection, and consumer protection statutes (as further identified in Appendix A); and (iii) any strict liability claim arising from your beta participation. California residents: You expressly waive the protections of California Civil Code § 1542, which provides: “a general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
(e) Indemnification. You agree to indemnify, defend (with counsel reasonably acceptable to AskMyu), and hold harmless AskMyu and its officers, directors, employees, agents, successors, and assigns from and against any and all third-party claims, demands, suits, proceedings, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to: (i) your use of the Platform in violation of these Terms; (ii) your violation of any applicable law, regulation, or third-party right, including without limitation any privacy, data protection, biometric, or consumer health data law; (iii) any data, content, or information you submit through the Platform, including without limitation any claim by a third party whose data you input without authorization; (iv) your gross negligence or willful misconduct; or (v) any claim by a regulatory authority or private plaintiff arising from your beta participation that is attributable to your acts or omissions. AskMyu reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with AskMyu’s defense.
(f) Limitation on Release. Notwithstanding the foregoing, the releases and waivers in this Section 13 do not extend to claims arising from AskMyu’s own gross negligence or willful misconduct, or to any claims that cannot be released or waived as a matter of applicable law.
(g) Knowing and Voluntary Acknowledgment. YOU ACKNOWLEDGE THAT: (I) YOU HAVE READ THIS SECTION 13 IN ITS ENTIRETY AND UNDERSTAND ITS LEGAL EFFECT; (II) THIS SECTION WAIVES SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR STATUTORY DAMAGES UNDER APPLICABLE PRIVACY STATUTES (AS SET FORTH IN APPENDIX A); (III) YOU HAVE HAD A REASONABLE OPPORTUNITY TO CONSULT WITH LEGAL COUNSEL OF YOUR CHOOSING BEFORE AGREEING TO THESE TERMS; (IV) YOU ARE VOLUNTARILY AGREEING TO THIS RELEASE AND ASSUMPTION OF LIABILITY; AND (V) THIS RELEASE IS A MATERIAL CONDITION OF YOUR ACCESS TO THE BETA PLATFORM, WITHOUT WHICH ASKMYU WOULD NOT GRANT YOU SUCH ACCESS. IF YOU DO NOT AGREE TO THIS SECTION 13, DO NOT CLICK “I AGREE” AND DO NOT ACCESS THE PLATFORM.

APPENDIX A — YOUR RIGHTS AS A BETA PARTICIPANT
Different states give you different privacy rights. Here is what you should know, by state. In each case, AskMyu’s commitment is the same: we will not use your data in ways you have not consented to, we will not sell it, and we will respond if you have questions or want to exercise a right. California. You have the right to know what personal data we collect, to request that we delete it, and to opt out of any sale or sharing of your data. We do not sell your data. By using the Platform, you are consenting to AskMyu and its AI service providers processing the communications and inputs you submit — that is how the Platform works, and you are agreeing to it here. To exercise your California privacy rights, contact us at legal@askmyu.com.
Washington. Washington’s My Health My Data Act gives you rights over data that relates to your health. To the extent the Platform generates inferences that could be considered health-adjacent — for example, signals related to stress or workload — you are consenting to that processing as part of your beta participation. We will not sell that data. To ask questions or request deletion, contact us at legal@askmyu.com.
Illinois. Illinois has strong protections for biometric data — things like fingerprints, face scans, and voiceprints. The current beta Platform does not collect biometric identifiers. If that ever changes, we will tell you separately and get your written consent before collecting anything.
Nevada. Nevada gives you the right to opt out of the sale of your personal data. We do not sell your data. Contact us at legal@askmyu.com with any questions.
Connecticut, Colorado, and Virginia. You have the right to access, correct, and delete your personal data, and to appeal any decision we make about a rights request. Contact us at legal@askmyu.com and we will respond within the time your state requires.
Wherever you are. These disclosures reflect laws that exist today. Privacy law is evolving quickly and we will update this Appendix as new laws take effect — and when we do, we will let you know.
